Housing Legal Aid and Funding
Housing legal aid: who qualifies?
Clear answers for people seeking housing help in England and Wales. Eligibility depends on the funding scheme and your individual circumstances.
Who may qualify for housing legal aid?
Usually, three things must be checked: whether the housing problem is covered, whether you meet the financial rules, and whether the case satisfies the relevant merits criteria. Having a housing problem or receiving benefits does not automatically guarantee funding. We assess the circumstances before confirming whether we can take the case.
What housing problems can legal aid cover?
It may cover homelessness, possession or eviction, unlawful eviction and some serious housing-condition problems. Not every landlord-and-tenant dispute or claim for compensation is covered. The type of help available depends on the issue and the funding rules.
Can I qualify if I work?
Yes, employment does not automatically rule you out. For means-tested help, your income, permitted expenses, savings and other capital are assessed. A partner’s finances may also count. Tell us about your household circumstances rather than assuming you earn too much.
Does Universal Credit automatically qualify me?
Universal Credit and certain other income-related benefits can satisfy the income part of the usual means test. Capital must normally still be checked, and the legal issue and other funding conditions must also qualify. Not every benefit has this effect.
What if I have savings or own a home?
Savings, investments and property may affect means-tested eligibility. Disregards and other rules can apply, so the assessment is not simply the balance in one bank account or the value of your home. Please provide details so the position can be checked.
Can I get help if I have received an eviction or repossession notice?
Seek advice immediately. In England and Wales, the Housing Loss Prevention Advice Service offers free early advice from the point you receive written notice that possession of your home is being sought. Financial circumstances do not affect access to that service. Free advice and representation may also be available at the possession hearing. Use the official provider finder below; do not assume this separate service means every stage of a housing case is free.
Can legal aid help with damp, mould or disrepair?
It may be available where housing conditions create a serious risk of illness or injury and the other funding requirements are met. Minor repairs and compensation-only claims are not automatically covered. Keep photographs, repair reports, correspondence with the landlord and any relevant medical evidence.
What information should I have ready?
Have your tenancy agreement, notices, court papers, council decisions and any hearing or eviction date ready. For a financial assessment, we may need recent bank statements, payslips, benefit evidence and information about savings, property and household expenses. We will tell you which documents are needed and how to send them securely.
Does legal aid always mean I pay nothing?
Not necessarily. Depending on the funding and financial assessment, contributions or recovery of costs from money or property obtained or preserved may apply. Your adviser should explain any payment or repayment obligations before you proceed. The Housing Loss Prevention Advice Service described above is free.
Does Qazi & Co offer legal aid for other areas of law?
We assess eligible housing matters for legal aid. For debt and welfare-benefits enquiries, the firm will consider taking a case on only once the matter is before the Upper Tribunal. This is the firm’s acceptance policy, not a general statement that all debt disputes belong in the Upper Tribunal or qualify for legal aid. We must check the precise proceedings, our authorisation to undertake the work, scope, financial eligibility, merits and capacity before confirming funding or accepting instructions. We do not offer a general legal aid service for initial debt advice or First-tier Tribunal benefits appeals. Immigration and our other services are privately funded. If your problem is at an earlier stage, contact Civil Legal Advice or Citizens Advice for suitable help.
How do I ask for an assessment?
Email housing@qazisolicitors.com, call 020 3161 5450, or use our enquiry form and select Housing. Give a brief outline and any urgent dates. Do not put bank details or sensitive documents in the initial form. An enquiry does not confirm legal aid, acceptance of instructions or an appointment.
